Condo owners' appeal denied

Ruling allows SMU to proceed with demolition

A federal court judge refused to grant a stay on the appeal of the University Gardens condo owners, allowing SMU to begin demolition on the property.

Judge Jerry Buchmeyer upheld his ruling Wednesday, which said SMU is the sole owner of the complex and is entitled to begin knocking down the units.

Buchmeyer also assessed $18,000 worth of court costs against the tenants, which include attorney Gary Vodicka and co-litigant Robert Talfel.

SMU has not set a date yet for demolition of the complex, but has spent the past two months preparing the property for such an event.
